Biography:
Amy L. Miner has concentrated her practice on insurance coverage matters for over 17 years. Amy’s practice has involved the analysis of and litigation regarding general liability and professional liability policies on both primary and excess layers on a national basis. The scope of Amy’s practice has ranged from policy drafting to multi-million dollar complex coverage trials.
Amy’s recent significant victories include her November 2005 win before the U.S. Court of Appeals for the Ninth Circuit. Following extensive briefing and oral argument, the Ninth Circuit agreed that the notice-prejudice rule does not apply to claims made policies and ruled essentially that a policyholder must use a broad construction in determining whether a claim is being asserted against said policyholder.
Another notable example was the 3M breast implant trial that was tried in Minneapolis over the course of several months.
Amy has also been involved with various insurance companies in the drafting of their policies. As examples, she worked with many carriers to draft endorsements for the Y2K threat and mold claims.
She continues to consult with a number of carriers regarding revising endorsements to address emerging issues.
Other professional activities include providing seminars regarding topics including bad faith, claims handling and duty to defend/estoppel issues.
Amy is licensed in eight states in addition to the District of Columbia, the U.S. Supreme Court and multiple federal districts.
